DMCA Policy

Mixed Summer Fruit Crisp ("we", "us", or "our") respects the intellectual property rights of others and operates in accordance with the Digital Millennium Copyright Act (DMCA). This policy outlines the procedures for copyright owners to notify us of alleged copyright infringement and for users to submit counter-notifications when their content has been removed due to a DMCA takedown notice.

Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the "Mixed Summer Fruit Crisp" website, you may notify our designated copyright agent. For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work that you claim has been infringed.

Filing a DMCA Counter-Notification

To be effective, a Counter Notification must be a written communication provided to our designated agent that includes substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which "Mixed Summer Fruit Crisp" may be found, and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.
